Documents claim unvetted Afghan refugees entered US under Biden-Harris Administration

New documents obtained by America First Legal (AFL) reveal discrepancies in the Biden-Harris Administration's claims regarding Afghan refugees brought to the United States. The administration had stated that these individuals were allies who had assisted the U.S. government, but officials now admit they did not know their identities.

Kamala Harris had repeatedly referred to these refugees as "our Afghan allies." However, it has emerged that the U.S. government lacked knowledge of their identities, and some have allegedly committed crimes against Americans.

America First Legal acquired these documents through litigation against the Department of Justice after it resisted an investigation into the administration’s decisions during the withdrawal from Afghanistan. AFL stated, “The documents we received reveal utter chaos and incompetence.”

In early August 2021, according to AFL, the Department of State asked federal agencies to verify a spreadsheet listing Afghans who did not meet minimum time-in-service for a Special Immigrant Visa (SIV). These individuals were being considered for referral to the U.S. Refugee Admissions Program (USRAP) because they had supposedly worked on behalf of the United States or a U.S.-funded program.

The U.S. Embassy in Kabul appeared unable to recognize any names on this list.

AFL also highlighted that even Afghans nominated by the embassy for USRAP faced significant challenges entering the United States. They needed to find their own way to a third country and support themselves while their applications were reviewed, security checks performed, and medical exams conducted.

Despite previous guidance requiring USRAP applicants to travel independently to a third country, hundreds left Afghanistan on U.S. Air Force cargo planes as early as August 15, 2021.

By August 31, 2021, according to AFL’s findings, the administration was still formulating its official stance on "Screening & Vetting" processes intended to prevent dangerous individuals from entering.

The Department of Homeland Security Inspector General reported that many Afghans were flown into the United States without full vetting despite supposed requirements for waiting in a third country during application reviews.

As of July 2024, according to the Department of State Inspector General, there is no confirmed number of individuals evacuated from Afghanistan with U.S. government support in 2021.

The Biden-Harris Administration claims it evacuated over 123,000 people from Afghanistan; only 6,000 are American citizens.

America First Legal states it will continue its efforts through litigation to expose what it calls "the Biden-Harris Administration’s duplicity and disregard for our national security."
